Terms of Service

1. Who we are

PosGPT is operated by Dev Dutt Choudhary. References in these terms to “PosGPT,” “we,” “us” or “our” mean that operator. Our registered contact for legal notices is legal@posgpt.uk; our support contact is support@posgpt.uk.

2. What you get

A subscription to the PosGPT cloud point-of-sale software at app.posgpt.uk, including the modules listed on our home page (point-of-sale, kitchen display, floor plan, reports, payments integrations, and so on) for as long as your subscription is active and in good standing.

We may add features, improve existing ones, and retire features that are unused or unsafe to operate. Material removals will be announced at least 30 days in advance via email to the account owner.

3. The contract

When you click “Start free trial” and enter your card via Paddle, you enter into a binding contract with us on these terms. English law governs the contract and the courts of England and Wales have non-exclusive jurisdiction over any dispute arising from it.

Your subscription starts on the day you complete signup. The first 60 days are free of charge; from day 61 onwards your card is billed at the rate displayed on our pricing page at signup time, plus UK VAT where applicable.

4. Cancellation and refunds

You may cancel any time from your dashboard. If you cancel during the free trial you are not charged. If you cancel after the trial, access continues until the end of the billing period you have already paid for; we do not pro-rate refunds for unused days.

5. Your data

Data you enter or generate (menus, orders, receipts, customer records) belongs to you. We process it as a data processor on your behalf in line with our Privacy Notice.

You can export your data via the dashboard at any time. If you cancel and ask us to delete it, we will do so within 30 days, retaining only what UK law requires us to keep for tax and accounting purposes.

We may suspend or terminate accounts that breach these rules without refund. Where the breach is criminal, we may share information with the police in line with our Privacy Notice.

7. Service availability

We aim for 99.5% monthly uptime. Planned maintenance windows are announced 48 hours in advance. We do not guarantee availability during emergency security maintenance.

If we miss the uptime target in a given month, you can claim a service credit equal to the prorated daily fee for each full hour of downtime, capped at one month’s subscription per incident. The credit is applied to your next invoice; we do not refund cash.

8. Third-party integrations

PosGPT integrates with Paddle for subscription billing and (at your option) Square for card payments. Those services have their own terms which you accept directly with them. We are not responsible for their behaviour beyond our own integration code.

9. Liability

Nothing in these terms limits liability that cannot be limited by law (death, personal injury caused by negligence, fraud).

Subject to that, our total liability to you in any 12-month period is capped at the fees you have paid us in that period. We are not liable for indirect or consequential loss, loss of profit, loss of anticipated savings, or loss of goodwill.

10. Changes to these terms

We may update these terms. Material changes will be announced at least 30 days in advance via email to the account owner. Continued use after the announced effective date is your acceptance of the new terms. If you do not accept them you may cancel without penalty during the notice period.
